Returns, Refunds, and Statutory Warranties
Article A: General Return Policy
Except as provided by applicable law, the following shall govern returns of goods to Tibi:
1. The following goods are subject to final sale and not returnable: (a) all jewelry; (b) all bodysuits; and (c) all sale merchandise.
2. Tibi.com will accept returns of full price merchandise within 14 days from the date on which your order is received by you. To start a domestic or international return, visit tibi.loopreturns.com (the “Returns Portal”). If, for any reason, you cannot proceed with your return through the Returns Portal, please reach out to customercare@tibi.com.
3. All online orders must be returned to Tibi.com by mail or to a Tibi Boutique (see https://tibi.com/pages/stores). For all domestic returns, we can provide a pre-paid return label. Please note returns must be sent back to Tibi from the country in which you received them. Customs duties and sales taxes are non-refundable through Tibi, but you may be able to recover these fees by contacting your local customs authority.
4. In-store purchases must be returned to a physical retail location. Please inquire with the boutique in which your order was placed to initiate a store return.
5. All returns will incur a $12 processing & handling fee that will be deducted from the amount of your refund back to your original form of payment.
6. Returns must be received by Tibi in their original condition, i.e, unused, unworn, unwashed, unaltered, and undamaged with all tags and packaging included. Swimwear must have the sanitary lining still intact and be in its original packaging. Footwear must be returned with no visible wear on the soles; and shoe boxes are considered part of the product and must also be returned undamaged in order to receive a full refund. Items must not have been used for personal or promotional purposes in photography shoots, social media, or commercially. Return approval is at Tibi’s discretion. Returns that fail to comply with this policy may be rejected and the goods may be sent back to the customer. Tibi also reserves the right to restrict customer returns based on high frequency or abnormal and/or suspicious return patterns.
Article B: UK and EU Statutory Rights
Notwithstanding any of the above, consumers in the European Union and United Kingdom have the following rights:
14-Day Returns for Purchases from the EU and UK
1. Notwithstanding anything contained in the previous section, consumers in the EU and UK have the right to return any goods purchased from Tibi.com within 14 days from delivery of the goods, and to receive a refund in full, back to the original form of payment, which refund shall include shipping costs. The cost of shipping the goods back to Tibi must be paid by the consumer.
2. Consumers should exercise their right by clicking the “Cancel items” button associated with their purchase (if available in your country or region). However, they may also use the means specified in Article A, Section 2 above.
3. If the goods have already been shipped by Tibi or received by the consumer, Tibi has the right to withhold the refund until the goods have been returned or the consumer has provided proof of dispatch.
4. Unless required by law, Tibi does not reimburse the consumer for any duties or taxes incident to receipt of the goods. The reimbursement is limited to the amount the consumer paid Tibi. However, if the consumer has requested special shipping, Tibi is only required to refund the equivalent of Tibi’s least expensive shipping option.
5. Returns are not subject to a processing or handling fee.
6. Returns should be unused, unworn, unwashed, unaltered, and undamaged with all tags and packaging included. If, upon receipt, Tibi determines that the commercial value of the goods has been diminished, Tibi will have the right to refund only the diminished value of the goods.
EU and UK Statutory Warranties for Defective Goods
1. Under the laws of the United Kingdom and European Union, Tibi is under a legal duty to supply goods that are in conformity with your order. Consumers in those jurisdictions have statutory rights in relation to goods that are, at the time of delivery, faulty or not as described, subject to certain statutory limitations and exceptions summarized in Section 4 below. For EU consumers, the minimum statutory warranty is two (2) years, although some countries provide for longer periods.
2. If a good is confirmed to be defective under these statutory rights, Tibi will repair or replace the item free of charge, including covering the cost of return shipping for the defective item and outbound shipping for the replacement. If repair or replacement is impossible, disproportionate, or cannot be completed within a reasonable time, you are entitled to request a price reduction or a full refund of the amount paid to Tibi.
3. All Tibi orders are shipped Delivered Duty Unpaid (DDU). In the event of a refund for a defective item, Tibi will refund the original purchase price and standard shipping costs paid directly to us. Tibi is not responsible for, and cannot refund, import duties, customs fees, or local taxes paid to third parties. Consumers must contact their local customs authority directly to reclaim any duties or taxes paid on defective or returned items.
4. The foregoing statutory rights are subject to the limitations and exceptions set forth in the UK Consumer Rights Act 2015 and applicable EU and national consumer protection laws, which expressly exclude normal wear and tear, misuse, and accidental damage (such as failure to follow care instructions). By way of example, but not limitation, we do not accept returns or exchanges for items damaged by:
• Everyday wear and tear
• Improper storage or use
• Accidental or deliberate damage
• Burns, rips, or cuts
• Not following care or use instructions
• Using an item after reporting an inherent fault
• Personal alterations
• Not washing according to the care label
• Repairs or alterations done by anyone not authorized by Tibi in writing
